AKENA Technologies offers a range of services (hereinafter referred to as the "Services") enabling Internet users to view, create and post vacation rental property listings.

These Services are provided through several websites referred to collectively under the trade name, "MediaVacationRentals." A list of these websites appears on: http://www.mediavacationrentals.com

The use of the Services is governed by the terms set forth below and is restricted to private individuals (hereinafter referred to as the "User") who own a property or several properties.

To gain access to the Services, the User is required to open a user account. The user account registration form must be filled in completely and the User must only submit information which is true and accurate.

The information submitted by the User during the registration process will appear along with his/her listing(s) and is visible to Internet users who view the listing(s).

Any change in the personal information given by a User for his/her account (such as change in address, telephone number or other contact details) must be promptly updated in the User's account registered with MediaVacationRentals.

Pursuant to the provisions of the French Freedom of Information and Data Protection Act #78-17 of January 6th, 1978, the User is hereby informed that the information submitted during the registration process is required for the provision of the Services. The information submitted by the User is intended primarily for use by the Company to process the User's inquiries, to notify Users of available personalized services and to keep Users informed of the general products and services offered by the Company. Only information regarding the listings may be disclosed to third parties, and will only be used in efforts to improve the Service's performances.

AKENA Technologies is committed to its privacy policy and will not disclose Users' information, especially their email addresses.

By law, the User is entitled to access, modify, rectify and/or delete any personal information that has been submitted. To exercise this right, simply contact us using this contact form.

Vacation rental property listings will appear on MediaVacationRentals for the duration of their validity period.

The User acknowledges and accepts that AKENA Technologies alone shall have the power of decision in matters concerning:

the layout of the information contained in the vacation rental property listings;
the content of specific listings;
the general content of the MediaVacationRentals website;
the listings and Internet links displayed on the websites;
the order in which vacation rental property listings appear on the site(s);
and the general conditions under which listings appear on the site(s).

The User also acknowledges that the conditions of publication may be modified by AKENA Technologies at its discretion and without prior notice.

Prices are listed in the "Prices and payment" section and are subject to change without prior notice.
The prices shown include the publication of a listing on MediaVacationRentals websites for a period of time established by AKENA Technologies (generally one year) and may not be changed by the User.
No refunds, partial or full, will be issued for any reason whatsoever.

The User may, without justification, exercise his/her right of withdrawal at any time within 7 days of the date of creation of the listing, provided the listing has not already been activated. To exercise this right, the User must inform AKENA Technologies of his decision by e-mail, using the Contact page in the Owners Section.

AKENA Technologies shall:

1. publish User listings on the MediaVacationRentals website, unless it is unable to do so due to unforeseen circumstances or to an event beyond its control;
2. implement measures aimed at increasing the number of visits to the website and improving the commercial impact of the published listings;
3. provide owners with support services, in particular through the maintenance of an online Help section and through e-mail support;
4. implement measures aimed at generally improving the website and the quality of service provided;
5. not disclose the User's personal contact details to any third party.

The User shall:

1. submit personal details which are accurate and true;
2. delete all obsolete listings;
3. accurately describe the property(ies) available for rent, including any relevant caveats;
4. verify that the content of his/her listing(s) and his/her owner account details are up-to-date;
5. reply to inquiries made through MediaVacationRentals websites.

The User shall refrain from using his/her vacation rental property listing as a means of promoting his/her professional interests, especially if such interests are related to vacation rental properties or tourism. The link to the "owner's website" displayed in each vacation rental property listing should point to a website which is unequivocally non-professional in nature, and on which no more than 5 properties are listed.

The User declares that he/she will comply with any legal provisions governing the vacation rental property sector and/or commonly accepted practices in this sector of activity.

The User agrees to accept "cookies," as well as to accept e-mails regularly sent by AKENA Technologies to inform the User of improvements in services.

Additionally, the User grants AKENA Technologies the right to use and highlight his/her listings and content for the purpose of promoting the Services, the MediaVacationRentals website and AKENA Technologies.

AKENA Technologies reserves the right (i) to modify or delete listings or user accounts without notice, and (ii) to deny renewal of listings or user accounts upon expiration of their subscription. This right may be exercised by AKENA Technologies in the following cases:

1. Listings or user accounts whose content has been found to be incomplete, illegal, fictitious, fraudulent or inconsistent with reality;
2. Users have deceived or have sought to deceive vacation rental customers or potential vacation rental customers with regard to the nature of the property made available for rent;
3. Information regarding potential inconveniences for a listing not given (i.e. excessive noise; mold; foul odors; poorly maintained wall surfaces; non-exclusive use of the property, its outbuildings and/or grounds; defective gates, doors and windows; water or gas leaks; defective furniture, heating appliances or air-conditioning; defective household appliances, plumbing facilities or sanitary installations; presence of excessive pet hair/fur; etc.);
4. General abuse or misuse of the Services;
5. Publication of vacation rental accommodations that do not conform to relevant housing regulations, that pose a threat to occupants' security, or fail to provide a minimum level of comfort;
6. Rental conditions which do not conform to relevant housing regulations.

AKENA Technologies may also exercise this right in the event of:

1. Complaints by one or several vacation rental customers concerning the quality of an accommodation or rates deemed excessive in light of the services offered;
2. Listings which do not faithfully reflect the characteristics of the associated rental property or whose content is misleading.

AKENA Technologies reserves the right to (i) modify listings and user accounts, or (ii) deny renewal of listings and user accounts upon expiration of their subscription at its discretion.AKENA Technologies may, after examination, delete offending listings without notice and refund the subscription fee at an amount proportional to the remainder of the subscription period.

The User is hereby informed that if his/her user account or listing(s) are deleted for one or more of the reasons mentioned above, he/she may not open another user account, nor may he/she create further listings unless expressly authorized to do so by AKENA Technologies. In the absence of such authorization, AKENA Technologies reserves the right to delete any new listing(s) or user account(s) created by the User.

The User acknowledges and accepts that the specific nature of the Internet is such that it is impossible for AKENA Technologies to provide an absolute guarantee of the continuity of the Services provided, of response times and of the overall security of data transmissions in its operations, despite specific technical measures adopted by the Company.

The User acknowledges and accepts that the Services provided by the Company may be interrupted for maintenance purposes, or in cases of events beyond the Company's control or scope of responsibility.

AKENA Technologies may not be held liable in the event of malicious access to or use of Users' web pages, MediaVacationRentals, AKENA Technologies' servers or any of its technical service providers.

The User also acknowledges and accepts that the Services may contain errors of a technical or editorial nature which could lead to a loss of performance.

The User alone shall be responsible for the safe-keeping of passwords and access codes received after opening a user account. It is the User's duty to take whatever precautions may be necessary to ensure protection of this sensitive information.

In the event of loss or theft, or if the User becomes aware of the use of his/her access code by an unauthorized third party, the User should immediately notify the Company and cease using his/her account.

The Company is not liable for the effects of any fraudulent use of passwords and access codes by unauthorized third parties.

All of the Services provided herein are subject to all relevant French and international copyright and intellectual property laws.

The general structure of the Services, the images, sounds, textual and graphic content and all of the other components of the Services, with the exception of the information published by the User, are the exclusive property of the Company. The trademarks, trade names, logos and other illustrations displayed on the MediaVacationRentals website have, in some cases, been registered by the Company or by third parties and may not be used without the prior written approval of the Company or their respective owners.

To provide the Services, the Company uses notably a secure database of information which is in compliance with French law (Act no. 98-536 of July 1st, 1998).

This database was created by the Company for its own use. The non-authorized extraction and/or use of the contents of this database is strictly forbidden and the perpetrators of such acts may be held civilly and criminally liable. The Company reserves the right to initiate legal proceedings against any User who violates this prohibition.

The User acknowledges that he/she is acting on his/her own behalf, and assumes full responsibility for the content of his/her publications.

Additionally, the User attests that he/she is in possession of the required authorizations for publication of any images, texts and in general any data which may be published through the Services provided herein. The User shall assume full civil and criminal liability for the publication of such data, and this liability may be incurred in any proceedings initiated by third parties or public authorities concerning such publications made through the Services.

The User acknowledges and accepts that he/she alone is be responsible for his/her use of the Services and the content contained therein, whatever the nature of the latter and of the information published through these Services. The User also acknowledges and accepts that the Company is under no obligation to check or guarantee the accuracy, legality, quality or reliability of content created by Users, whatever the nature of such content as it is published through the Services.

The User shall be responsible for his/her own computer hardware and for the use he/she makes of it to access and use the Services. Similarly, the User alone shall bear all direct and indirect costs associated with accessing the Internet and the Services as well as the costs associated with the use they make of either.

The User assumes full responsibility for any information, messages, images, and, in general, all content he/she submits to the Company for publication. As such, the User shall fully assume, in full awareness of the implications, any civil and criminal liability for said publications, and shall alone be held accountable in any legal proceedings that may be initiated either by third parties or by concerned public authorities.

The User alone shall be responsible for any contacts made through the use of the Services.

The User hereby relieves the Company of all liability and holds it harmless against any court judgments which may be handed down further to the use of the proposed Services. The User also relieves the Company of all liability for any losses which may be incurred or caused by the User, either directly or indirectly, as a result of the latter's use of the proposed Services.

The Services and information are provided "as is," with no guarantee other than the Company's affirmation that it will make full use of the resources in its possession to provide high-quality services to its users. The User acknowledges and accepts that AKENA Technologies is bound by a best-effort obligation and gives no guarantee whatsoever with regard to the publication of the listings.

The Company does not guarantee the accuracy, comprehensiveness, or the perfect operation of the proposed Services, nor does it guarantee the absence of errors in said Services. The User acknowledges and accepts that the information placed at his/her disposal is neither complete nor exhaustive, and that it is his/her duty to check such information before use. Consequently, the User acknowledges and accepts that the Company is not liable for faults in the proposed Services or information, and that the User alone is wholly responsible for the use of said Services and information.

The Company will not intervene in any way in the transactions which may result from the use of the Services. As such, the Company will not be liable for any loss or damages incurred by owners or renters in the event of non-conformity, failure to enter into contract--whatever the nature--, non-payment, failure to deliver or, in general, any event arising from the use of the Services. Moreover, the Company gives no guarantee as to the solvency, the good faith, or the capacity of transacting parties.

The Company is not liable for any losses, whether direct or indirect, suffered by any user. This includes in particular any loss of clientèle, negative effects of legal proceedings, disruption of business, loss of image, or loss of earnings that arise as a result of the quality or the specifications of the products and services provided by the User, or as a result of payment operations.

Neither the Company nor any one of its partners or agents may be held liable for the use which is made of the proposed Services.

The use of the Services implies the unreserved acceptance of the Terms of Use outlined herein.

The Company reserves the right to change, modify, add or delete any or all of the provisions of these general terms and conditions, without notice, and to assign, transfer or sub-contract its rights and/or obligations hereunder. Under no circumstances may the User assign or transfer benefits acquired from the Company to any third party.

In continuing to use the Services, the User implicitly accepts any modifications which may have been made to said Services.
